1. What Are Mechanical Rights?

Mechanical rights refer to the right to reproduce a musical composition in a physical or digital format. In the context of digital music distribution, mechanical rights apply every time a song is:

Downloaded as a permanent digital file (e.g., iTunes purchase).
Reproduced as part of a streaming service's server infrastructure.
Included in a ringtone or digital karaoke track.
Reproduced in any other digital format that creates a copy.

Important: In South Africa, mechanical rights are administered by the South African Music Rights Organisation (SAMRO) and Composers, Authors and Publishers Association (CAPASSO) for the mechanical reproduction of musical works.

2. Types of Mechanical Rights

Digital Download

Rights for permanent digital downloads (MP3, AAC) where a copy is made and retained by the consumer.

Interactive Streaming

Rights for on-demand streaming where the user selects specific tracks (e.g., Spotify, Apple Music).

Non-Interactive Streaming

Rights for programmed streaming services (e.g., Pandora-style radio, certain YouTube features).

Ringtones & Alerts

Rights for reproduction of compositions as ringtones, notification sounds, and alert tones.

3. South African Collective Management

In South Africa, mechanical rights are managed through collective management organisations (CMOs):

SAMRO (South African Music Rights Organisation)

Administers performing rights and mechanical rights for musical works in South Africa. Members register their compositions and receive royalties when their music is performed or reproduced publicly.

CAPASSO (Composers, Authors and Publishers Association)

Specialises in mechanical rights administration. CAPASSO licenses the reproduction of musical works and distributes mechanical royalties to rights holders.

SAMPRA (South African Music Performance Rights Association)

Administers neighbouring rights (performers' rights) and sound recording royalties for featured artists and record labels.

4. FFP Radio Distribution and Mechanical Rights

As your digital distributor, FFP Radio Distribution facilitates the licensing of mechanical rights on your behalf:

We ensure that DSPs have the necessary mechanical licences in place for your content.
We collect and distribute mechanical royalties as part of your overall royalty payments.
We provide detailed reporting showing mechanical royalty earnings separately from performance royalties.
We recommend that all composers and songwriters register with SAMRO and CAPASSO to ensure full royalty collection.

Note: FFP Radio Distribution does not replace your CMO membership. We recommend maintaining active membership with SAMRO and CAPASSO to maximise your royalty collection across all exploitation channels.

5. Mechanical Royalty Rates

Mechanical royalty rates vary by platform and usage type:

Permanent Downloads: Typically 9.1% of the retail price or a statutory rate per download.
Interactive Streaming: A percentage of revenue or a per-stream rate determined by the platform and CMO agreements.
Physical Media: Statutory rate per unit manufactured (less relevant for pure digital distribution).

Exact rates are negotiated between CMOs and DSPs and may change periodically. Your royalty reports will reflect the current applicable rates.

6. Your Responsibilities

To ensure proper mechanical rights administration:

Register with SAMRO: Ensure all your compositions are registered with SAMRO as both a composer and publisher member.
Register with CAPASSO: Register for mechanical rights collection through CAPASSO.
Accurate Credits: Provide complete and accurate composer and publisher credits for every track you submit.
Split Agreements: Document and communicate any revenue-sharing agreements with co-writers and publishers.
Keep Records: Maintain records of all registrations, agreements, and royalty statements for tax and audit purposes.

7. Common Mechanical Rights Issues

Unregistered Works: If your composition is not registered with SAMRO/CAPASSO, mechanical royalties may go uncollected.
Missing Credits: Incomplete composer or publisher metadata can result in misallocated royalties.
Cover Versions: Recording a cover requires a mechanical licence from the original publisher. We can assist with this process.
Sampling: Using a sample from another recording requires clearance from both the sound recording owner and the composition rights holder.
