1. Copyright Overview

Copyright is a legal right that grants the creator of an original work exclusive rights to its use and distribution. In South Africa, copyright is governed by the Copyright Act, 1978 (Act No. 98 of 1978) and its amendments.

At FFP Radio Distribution, we respect intellectual property rights and are committed to protecting the creative works of our artists and rights holders.

2. Types of Copyright in Music

Musical Work

The composition itself — melody, harmony, and lyrics. Protected as a literary and musical work. Owned by the composer/lyricist or their publisher.

Sound Recording

The master recording of a performance. A separate copyright from the underlying composition. Owned by the performer or record label.

Artwork

Cover art, promotional images, and visual materials. Protected as artistic works under copyright law.

Literary Work

Lyrics, liner notes, and written descriptions. Protected as literary works independent of the musical composition.

3. Duration of Copyright

Under South African law, copyright duration is as follows:

Literary and Musical Works: 50 years from the end of the year in which the author dies.
Sound Recordings: 50 years from the end of the year in which the recording was first published or, if unpublished, 50 years from fixation.
Artistic Works: 50 years from the end of the year in which the author dies.
Published Editions: 50 years from the end of the year of first publication.

Note: South Africa has extended the copyright term for sound recordings to 70 years from publication under recent amendments, aligning with international standards. Always verify the current applicable term for your works.

4. Copyright Protection on FFP Radio Distribution

We implement the following measures to protect copyright:

Content ID Systems: We work with DSPs to implement content identification and fingerprinting technology.
Verification Process: All submitted content undergoes review to verify ownership claims.
Duplicate Detection: We flag potential duplicate or infringing uploads before distribution.
Takedown Compliance: We respond promptly to valid DMCA-style takedown notices.
Artist Education: We provide resources to help artists understand and protect their copyright.

5. Copyright Infringement Policy

FFP Radio Distribution has a zero-tolerance policy for copyright infringement. Users who submit content that infringes the rights of others will face:

Immediate removal of infringing content from all DSPs.
Suspension or termination of the offending account.
Forfeiture of any royalties associated with infringing content.
Reporting to relevant authorities for serious or repeated violations.
Potential legal action for damages caused by infringement.

Warning: Knowingly submitting infringing content is a criminal offence under the Copyright Act and the Cybercrimes Act, 2020. Penalties may include fines and imprisonment.

6. DMCA-Style Takedown Procedure

If you believe your copyright has been infringed on the FFP Radio Distribution platform or through our distributed content, please follow these steps:

Identify the Infringement
Provide the exact URL, song title, artist name, and DSP where the infringing content appears.
Submit a Written Notice
Email your takedown notice to copyright@ffpradio.co.za with:
- Your full name and contact details.
- A description of the copyrighted work you claim has been infringed.
- The location of the infringing material.
- A statement that you have a good faith belief that the use is not authorised.
- A statement that the information is accurate and you are the copyright owner or authorised to act on their behalf.
- Your electronic or physical signature.
Review Period
We will review your notice within 48 hours and take appropriate action, including content removal if the claim is valid.
Counter-Notification (if applicable)
If the uploader disputes the claim, they may submit a counter-notification. We will provide you with a copy and guidance on next steps.

7. Counter-Notification Procedure

If your content has been removed due to a copyright claim and you believe the removal was erroneous, you may submit a counter-notification containing:

Your full name, address, and contact details.
Identification of the removed content and its location before removal.
A statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification.
A statement consenting to the jurisdiction of the South African courts.
Your electronic or physical signature.

Important: Filing a false counter-notification may result in legal liability. Ensure you have a valid basis before submitting.

8. Tips for Protecting Your Copyright

Register with CMOs: Join SAMRO, CAPASSO, and SAMPRA to ensure comprehensive rights management.
Document Everything: Keep records of creation dates, drafts, and agreements with collaborators.
Use Watermarks: Watermark preview versions of your tracks before official release.
Monitor Your Content: Regularly search DSPs for unauthorised uploads of your work.
Register with CIPC: Consider registering your copyright with the Companies and Intellectual Property Commission for additional legal protection.
Clear Samples: Always obtain proper clearance before using samples from other recordings.
